OTI License and Scope#
Colivelo Shipping is licensed as an Ocean Transportation Intermediary (OTI) — Freight Forwarder — by the Federal Maritime Commission (FMC) under 46 CFR Part 515. Our FMC-OTI license number is 026421F. Colivelo maintains the required surety bond and passenger liability insurance as a condition of its OTI license.
This Rules Tariff is published in accordance with 46 CFR Part 520 and is available for public inspection at https://coliveloshipping.com/rules-tariff. It governs the terms and conditions under which Colivelo arranges ocean transportation for Shipper accounts.
Tariff Publication and Access#
Colivelo publishes its tariff rules, rates, and charges electronically via this website. Rates are determined through negotiated service contracts with Shippers (for NVOCC services) and through spot quotations for individual Shipments. All rates are available upon request by contacting support@coliveloshipping.com.
Colivelo may revise, amend, or cancel tariff rules and rates at any time, with such changes becoming effective upon publication. Notice of general rate increases (GRIs) will be published at least 30 days before the effective date, in accordance with FMC requirements.
Rate Determination#
Freight rates for ocean shipments are determined based on the following factors:
- Commodity: Rates vary by cargo type, handling requirements, and stowability.
- Origin and destination: Port-to-port or door-to-door rates depend on the trade lane and inland transport requirements.
- Container type and size: FCL rates are quoted per container (20', 40', 40' HC, 45' HC). LCL rates are quoted per revenue ton (W/M — weight or measurement, whichever is greater).
- Service level: Standard, expedited, or time-definite transit options.
- Volume and frequency: Service contracts with minimum quantity commitments (MQC) may qualify for discounted rates.
- Seasonal factors: Peak season surcharges and general rate increases apply as published.
Accessorial and Surcharges#
The following accessorial charges and surcharges may apply in addition to base ocean freight rates:
- Bunker Adjustment Factor (BAF): Adjusted quarterly to reflect fuel cost changes. The current BAF is published on our website.
- Currency Adjustment Factor (CAF): Applied to certain trade lanes to account for currency exchange rate fluctuations.
- Low Sulphur Surcharge (LSS): Applied to shipments on routes requiring low-sulphur fuel compliance.
- Peak Season Surcharge (PSS): Applied during periods of high demand, typically July–October on trans-Pacific lanes.
- General Rate Increase (GRI): Published at least 30 days in advance per FMC requirements.
- Equipment Repositioning Charge: Applied when containers must be repositioned empty to meet Shipper requirements.
- Detention and Demurrage: Charged by the ocean carrier or terminal for container use beyond free time. The current free time and per-diem rates are as stated in the carrier's tariff or terminal schedule.
- Port Congestion Surcharge: Applied when a port experiences significant congestion delays, as published.
Documentation Fees#
Colivelo charges a documentation fee per shipment to cover the cost of preparing and transmitting the BOL, customs documentation, and carrier instructions. The standard documentation fee is $35 per BOL. Additional fees apply for: amendment or re-issuance of a BOL after sailing ($50), telex release ($45), and certificate of origin processing ($30).
Free Time, Detention, and Demurrage#
Free time for container pickup and return is determined by the ocean carrier's tariff. Typically, 4–7 days of free time are allowed for import containers and 3–5 days for export containers. After free time expires, detention charges apply for container use and demurrage charges apply for container storage at the terminal. Detention and demurrage rates are governed by the carrier's published tariff and are passed through to the Shipper without markup.
Rules and Conditions of Carriage#
All shipments arranged by Colivelo are subject to the following conditions:
- Shipments are accepted subject to the terms and conditions of the BOL issued for the shipment. See our Bill of Lading Terms for details.
- Colivelo reserves the right to refuse any shipment that is improperly packed, misdeclared, or contains prohibited goods.
- Hazardous Materials shipments must be declared at the time of Booking and accompanied by all required Hazmat documentation.
- Personal effects and household goods shipments require a detailed packing list with itemized values.
- Shipments with a declared value exceeding $50,000 require additional insurance coverage arranged at Booking. See our Insurance Coverage & Limits page.
- Colivelo is not responsible for delays caused by customs inspections, port congestion, carrier schedule changes, or force majeure events.
Dispute Resolution#
Disputes arising from this tariff or any service contract shall be resolved in accordance with the dispute resolution provisions of the applicable service contract or, in the absence of such provisions, through binding arbitration under the rules of the American Arbitration Association (AAA) in New York, New York.
FMC Bond Information#
Colivelo Shipping maintains a surety bond with the FMC as required by 46 CFR Part 515 for licensed OTI-Freight Forwarders. The bond ensures financial responsibility for transportation-related obligations. Bond details are available upon request.
